Return Policy
Version 3.0 – November 2024
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Day: calendar day
- Customer: a natural or legal person acting in the exercise of their profession or business, entering into an agreement with Twindis and/or having registered on the Website.
- Twindis: MyMicro Group B.V., located at Voorde 17-19, 5807 EZ Oostrum, registered with the Chamber of Commerce under number 56595581, trading under the name Twindis.
- Agreement: any agreement or contract between Twindis and the Customer, of which these General Terms and Conditions form an integral part.
- Written: "Written" in these general terms refers not only to letters but also includes email and fax communication, provided the identity of the sender and the integrity of the email are sufficiently established.
- Website: Twindis' website, accessible via www.Twindis.com and all related subdomains.
- General Terms and Conditions: These terms and conditions.
Article 2 – Applicability
- These General Terms and Conditions apply to all offers, Agreements, and deliveries of Twindis, unless expressly agreed otherwise in writing. The General Terms and Conditions are registered with the Chamber of Commerce and are also available on our website.
- If the Customer includes provisions or conditions in their claim or communication that deviate from or are not included in the RMA terms, Twindis explicitly rejects these.
- To the extent these conditions are also drawn up in a language other than Dutch, the Dutch text will always prevail in the event of discrepancies.
- In the event of a conflict between any provision in these RMA Terms and Conditions and the General Terms and Conditions, the latter shall prevail. Such a conflict does not affect the validity of the remaining provisions in these RMA Terms and Conditions.
- All rates and conditions mentioned in these RMA Terms and Conditions are exclusive of VAT.
Article 3 – RMA Procedure for Twindis Satisfaction Guarantee
The Twindis satisfaction guarantee is typically 60 days from delivery (invoice date). To accept and process a return, the Customer must submit an RMA request as described in Article 6, paragraph 1. The Twindis satisfaction guarantee is only applicable to products without defects; for defective products, the RMA procedure must be followed as described in Article 4.
The Twindis satisfaction guarantee is only applicable if the products are complete, including all accessories, and in their original packaging (undamaged, unmarked, and without stickers). If these conditions are met, Twindis will credit the purchase amount or invoice amount upon request.
If the return does not meet these conditions, Twindis will generally reject the RMA and propose returning the product at the Customer's cost or disposing of the product in an environmentally friendly manner at Twindis' cost. These costs are listed in Article 7.
Additionally, Twindis may approve the RMA under certain conditions, subject to a depreciation of up to 100% of the purchase value depending on the condition of the product and/or packaging, as assessed solely by Twindis.
Article 4 – RMA Procedure for Defective Products
The warranty period starts from the moment of delivery (invoice date). Warranty for defective products will only be accepted if the products are complete, including all accessories. If a product purchased within 30 days from delivery is found defective, Twindis reserves the right to either replace the defective product, credit the purchase price, or offer a discount on an existing or new order, as mutually agreed with the Customer.
If the defect arises after a period of 30 days from the invoice date, Twindis reserves the additional option to have the product repaired. If offered and available, the Customer can opt to replace the defective product with an identical, similarly aged (or newer), and equivalent or better-quality product, but this will forgo repair and ownership of the reported product.
Defects and software/configuration issues resulting from using the product in an application for which it was not specifically intended are always excluded from the warranty unless this has been discussed and agreed upon with Twindis in advance.
If, upon inspection, no defects are found and the device functions as intended, Twindis will reject the RMA and may charge investigation costs. Twindis will then offer the Customer the option to return the product or dispose of it in an environmentally friendly manner. The costs for investigation, return, and disposal are outlined in Article 7.
Article 5 – RMA Procedure for Shortages and Damage Upon Delivery
Any shortages or damage upon delivery must be reported via our website, by phone, or email within 3 working days of receipt. Twindis reserves the right to conduct necessary investigations before agreeing to the conclusion and will handle the RMA request and/or replacement order (unless otherwise agreed).
Article 6: General RMA Procedure
Returning products by the Customer is only permitted under the following conditions.
- To return defective goods or goods covered by the Twindis Satisfaction Guarantee, an RMA number must always be requested. The Customer must submit the RMA request form, fully completed, to the Twindis RMA department as listed on the Twindis website. The request form is also available on the Twindis website. An RMA can only be requested for products that are still under warranty.
- Incomplete or unclear forms will not be processed. Products can only be sent after Twindis assigns an RMA number. The RMA number must be clearly visible on the outside of a sturdy shipping box (not on the product packaging itself). No rights can be derived from the warranty handling listed on the RMA form. The existence and scope of any applicable warranty will be determined as soon as possible after Twindis receives the defective product. The transportation risk of returned products lies with the Customer, who must always ensure the correct packaging method, packaging type, and any legally required labels and/or identification marks.
- Returns without prior registration through our portal/RMA form, or returns of RMA requests that are not approved, will be immediately rejected by Twindis. Twindis will then propose either to return the product at the Customer's expense or to dispose of the product in an environmentally friendly manner at the Customer's expense. These costs are described in Article 7.
- After authorization by Twindis in accordance with the above provisions, the products must be returned within 30 days to the following address:
TWINDIS
RMA Department
De Voorde 17-19
5807 EZ Oostrum
The Netherlands - If there are ambiguities upon receipt of the products—either due to a discrepancy between the delivered product and the product registered in the RMA, or due to the delivery of multiple items that cannot be linked to a complaint or RMA number—Twindis will attempt to obtain the missing information from the Customer and place the RMA on hold pending the Customer’s response. If the required information is not sufficiently provided within 14 days of the request, Twindis reserves the right to reject the RMA and directly return the products to the Customer. The costs, as described in Article 7, may be charged.
- Customer-specific products made to order, products modified or altered by the Customer, and products permanently equipped with accessories or components that are not standard cannot be returned under any circumstances.
- Damage caused by falls, water, misuse, or normal wear and tear is excluded from the warranty. However, such products may, in consultation with Twindis and only for specific products, be submitted as an RMA, in which case additional repair costs will apply and be charged to the Customer. For damages incurred during transportation to the Customer, the conditions outlined in Article 5 apply.
Article 7 – Costs
If an RMA is rejected on the grounds of:
- A return not registered in advance
- An RMA request outside the satisfaction guarantee
- No defects found and the device functions as intended
Investigation costs and, depending on the Customer's choice, additional costs may be charged as outlined below. These costs will be reviewed at the beginning and in the middle of a calendar year and may be adjusted at the discretion of Twindis.
